When you use perlaindia.com ("Perla India," "we," "us," or "our"), it is understood that your usage is subject to the notices, terms, and conditions set forth in this Agreement. In addition, when you use any Perla India service or feature (e.g., product reviews, wishlist, account), you will be subject to the rules, guidelines, and policies applicable to such service, which are incorporated into this Agreement by reference.
Perla India reserves the right to change these terms and conditions at any time. Continued use of this Site following any such change constitutes your agreement to the revised terms.
Accessing, browsing or otherwise using the Site indicates your agreement to all the terms and conditions in this Agreement, so please read this Agreement carefully before proceeding.
1. Use of the Website
You represent and warrant that you are at least 18 years of age, or are accessing the Site under the supervision of a parent or guardian.
Subject to the terms and conditions of this Agreement, Perla India grants you a limited, revocable, non-transferable and non-exclusive licence to access and use the Site by displaying it on your internet browser, solely for the purpose of personal shopping and not for any commercial use or use on behalf of any third party, unless explicitly authorised by Perla India in writing.
You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit this Site or any portion of it unless expressly permitted in writing by Perla India. Perla India reserves the right to refuse service, suspend accounts, or cancel orders at its discretion, including where customer conduct violates applicable law or is harmful to Perla India's interests.
You shall not upload to, distribute, or otherwise publish through this Site any content or material that:
• Violates or infringes the copyrights, patents, trademarks, trade secrets, or other proprietary rights of any person;
• Is libelous, threatening, defamatory, obscene, indecent, or could give rise to civil or criminal liability under Indian law; or
• Contains bugs, viruses, worms, Trojan horses or any other harmful code or properties.
If Perla India assigns you a password and account identification, you are solely responsible for maintaining the confidentiality and security of your login credentials. You will be responsible for all activity occurring under your account. Notify us immediately at perla.delhi@gmail.com of any unauthorised use of your account or any security breach.
2. Reviews and Comments
Anything you submit or post to the Site — including ideas, reviews, comments, questions, and suggestions (collectively, "Submissions") — is and will be treated as non-confidential and non-proprietary. Perla India shall have the royalty-free, worldwide, perpetual, irrevocable, and transferable right to use, copy, distribute, display, publish, perform, sell, adapt, and create derivative works from such Submissions in any form and by any means.
All Submissions shall become the sole property of Perla India. When you post reviews or comments, you also grant Perla India the right to use the name submitted with such content.
You represent and warrant that you own or control all rights to the content you post, and that Perla India's use of your content will not infringe the rights of any third party. You shall not use a false name or email address, impersonate any person, or otherwise mislead Perla India or other users as to the origin of any Submission. Perla India may, at its discretion, remove or edit any Submission for any reason.
In any conflict between these terms and our Privacy Policy, our Privacy Policy shall prevail.
3. Risk of Loss & Terms of Sale
Risk of loss and title for items purchased from perlaindia.com passes to you upon Perla India's delivery of the items to the logistics carrier, pursuant to Perla India's standard terms of sale. Once your order has been dispatched and a tracking ID shared with you, the shipment is in transit under the carrier's custody.
4. Termination
Perla India may, without prior notice, immediately terminate this Agreement or revoke any or all rights granted to you under this Agreement. Upon termination, you shall immediately cease all access to and use of the Site. Perla India may revoke all passwords and account access immediately. Any termination shall not affect the rights and obligations of either party that arose prior to the date of termination, including any outstanding payment obligations.
5. Geographic Scope
perlaindia.com is operated from India and is primarily intended for customers within the Republic of India. Perla India currently ships only within India. References to products on the Site do not imply that such products will be made available outside India. If you access this Site from outside India, you are solely responsible for complying with your local laws and regulations.
6. Disclaimer and Limitation of Liability
Except as otherwise provided in the standard terms of sale, this Site, the products offered on it, and all transactions conducted through it are provided on an "as is" basis. Perla India makes no representations or warranties of any kind, express or implied, as to the operation of the Site, the accuracy of information, or the products listed.
To the fullest extent permissible by applicable law, Perla India disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and data accuracy. Perla India will not be liable for any damages of any kind arising from the use of this Site, including indirect, incidental, punitive, or consequential damages. Perla India's total aggregate liability to you shall not exceed the amount actually paid by you to Perla India during the one-month period immediately preceding the act allegedly giving rise to liability.
7. Pricing and Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to a typographical or system error, Perla India reserves the right to refuse or cancel any order placed for the incorrectly listed product — whether or not the order has been confirmed and payment processed. If payment has been charged and the order is cancelled due to such an error, a full refund will be initiated promptly to the original payment method.
8. Third-Party Links
This Site may contain links to third-party websites. Perla India is not responsible for the content, accuracy, or operation of any such site. Links to third-party sites are provided solely as a convenience and do not constitute endorsement, sponsorship, or recommendation by Perla India. You access any third-party site entirely at your own risk.
9. Copyright Complaints
Perla India respects the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please write to us at perla.delhi@gmail.com with full details of the alleged infringement, including the nature of the copyrighted work and the location of the infringing content on our Site.
10. Remedies
You agree that any breach or threatened breach of this Agreement by you would cause irreparable harm to Perla India for which monetary damages would be inadequate, and that Perla India shall be entitled to seek specific performance, injunctive relief, or any other equitable remedy, in addition to any damages recoverable at law.
No waiver by Perla India of any right or remedy shall imply any obligation to grant a similar, future, or other waiver.
11. Severability and Entire Agreement
If any provision of this Agreement is found to be invalid or unenforceable under applicable law, that provision shall be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original, and the remainder of the Agreement shall continue in full force and effect.
This Agreement constitutes the entire agreement between you and Perla India with respect to your use of this Site and supersedes all prior or contemporaneous communications, whether electronic, oral, or written.
12. Site Security
You are prohibited from violating or attempting to violate the security of this Site, including:
• Accessing data not intended for you, or logging into a server or account you are not authorised to access;
• Probing, scanning, or testing the vulnerability of any system or network, or breaching security measures without authorisation;
• Interfering with service to any user, host, or network, including via submission of a virus, overloading, flooding, spamming, or crashing;
• Sending unsolicited email or promotional communications; or
• Using any automated tool, software, robot, spider, or agent to scrape, navigate, or search this Site other than standard web browsers.
Violations of system or network security may result in civil or criminal liability. Perla India will investigate such violations and cooperate with law enforcement authorities as appropriate.
13. Nature of Products Sold
Perla India is a legitimate fashion and lifestyle brand specialising in intimate wear, nightwear, and loungewear for women. All products sold on this Site are legal for sale in India and are designed for personal use, comfort, and everyday wear.
Perla India is not an adult content platform. No pornographic, obscene, or objectionable material is promoted, sold, or hosted on this Site. Our product imagery is tasteful, fashion-appropriate, and intended for adult women shopping for personal apparel. By using this Site, you acknowledge that you are an adult purchasing fashion products for lawful personal use.

You may not reproduce, publish, transmit, distribute, modify, sell, or exploit any Contents without prior written permission from Perla India.
15. Disputes and Jurisdiction
In the event of any dispute or alleged breach of this Agreement, you agree to notify Perla India in writing at perla.delhi@gmail.com before initiating any legal action. Perla India shall be given a reasonable opportunity to investigate and, where applicable, rectify the matter.
This Agreement shall be governed by and construed in accordance with the applicable laws of the Republic of India. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Delhi.
16. Indemnity
You agree to defend, indemnify, and hold harmless Perla India, Stitch n Style, and their respective employees, directors, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of or access to this Site; (b) your breach of this Agreement; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party intellectual property or other rights. This clause shall survive the termination or expiry of this Agreement.
